These Terms of Service ("Terms") govern your use of the free guest wireless internet service (the "Service") provided by Hog City Tavern ("we," "us," or "our") at our premises in Lexington, North Carolina. By connecting to the guest network, submitting the sign-in form, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is offered free of charge as a courtesy to our guests. It is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be available at any particular time, that it will be uninterrupted or error-free, or that it will meet any particular speed or performance level. We may limit bandwidth, session length, or data usage, and we may suspend or discontinue the Service at any time without notice.
To use the Service you must complete our sign-in form, which asks for your name, mobile phone number, and optionally your email address. We verify your phone number by sending a one-time passcode by SMS text message. You must enter that code to be granted access. You agree to provide accurate information and to use only a phone number that belongs to you.
By entering your mobile number on our sign-in form and requesting a code, you consent to receive a one-time verification passcode by SMS from Hog City Tavern at the number you provided. This is a transactional, user-initiated message sent solely to verify your number and grant Wi-Fi access.
When you use the Service we collect: the information you enter on the sign-in form (name and mobile number); the hardware (MAC) address of the device you connect with; the network name and access point you connected to; the date and time of your sign-in; and the result of your verification and authorization. We use this information to verify your identity, grant and manage your access, remember your device so you do not have to sign in again for a period of time (currently up to 30 days), prevent abuse of the Service, and comply with legal obligations.
We do not sell your personal information. We do not share your mobile number or your SMS consent with third parties for their own marketing purposes. We use third-party service providers (our web host, our SMS delivery provider, and our network equipment vendor) solely to operate the Service, and each is permitted to use your information only for that purpose. We may disclose information if required by law, subpoena, or court order, or to protect our rights, property, or safety or those of others.
We retain sign-in records for [12 months] and then delete or anonymize them, unless a longer period is required by law. You may request access to or deletion of your information by contacting us at media[@]hogcitytavern[.]com.
You agree not to use the Service to:
We may monitor traffic volume and connection metadata to operate and protect the Service. We may block, throttle, or terminate access for any user who violates these Terms, at our sole discretion and without notice.
The Service is an open, shared wireless network. Data you send over it may not be encrypted and could be intercepted by others. You are responsible for securing your own device and data, including by using a VPN, HTTPS, and up-to-date software. We are not responsible for any loss, theft, or interception of data, or for any malware, virus, or other harmful code you encounter while using the Service. Do not use the Service to transmit information you consider sensitive.
Your session ends automatically after the time limit we set, when you leave the coverage area, or when we terminate it. We may terminate or suspend your access, and may refuse future access to any device or person, at any time and for any reason, including violation of these Terms.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE FULLEST EXTENT PERMITTED BY LAW, HOG CITY TAVERN AND ITS OWNERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF PROFITS, OR DAMAGE TO ANY DEVICE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE, YOU AGREE THAT OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
You agree to defend, indemnify, and hold harmless Hog City Tavern and its owners, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms or of any law or third-party right.
The Service is intended for use by adults. If you are under 18, you may use the Service only with the permission and supervision of a parent or guardian, who agrees to these Terms on your behalf. We do not knowingly collect personal information from children under 13.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Davidson County, North Carolina, and you consent to the jurisdiction of those courts.
We may update these Terms from time to time. The effective date at the top of this page indicates when they were last revised. Your continued use of the Service after a change constitutes acceptance of the revised Terms.
